Terms of Service

Terms governing your access to and use of Helper Advisor (www.helperadvisor.com). By using the Platform, you agree to be bound by these Terms of Service.

1.Acceptance of Terms

By accessing, registering for, or using the Helper Advisor platform, you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

These Terms apply to all users, including:

  1. Househelps (domestic workers seeking employment)
  2. Families/Employers (individuals or households seeking domestic services)
  3. Agencies (recruitment or placement agencies)

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

2.Eligibility and Account Registration

2.1 Age and Capacity

You must be at least 18 years old and legally capable of entering into binding contracts under Kenyan law to use this Platform.

2.2 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information promptly. False or misleading information may result in immediate account suspension or termination.

2.3 Account Security

You are solely responsible for:

  1. Maintaining the confidentiality of your login credentials
  2. All activities conducted under your account
  3. Immediately notifying us of any unauthorized access or security breach

We are not liable for losses arising from your failure to secure your account.

3.Data Protection and Privacy Compliance

3.1 We process personal data in strict compliance with the Kenya Data Protection Act, 2019. Helper Advisor has initiated the mandatory registration process with the Office of the Data Protection Commissioner (ODPC) as a Data Controller and Processor. We adhere to the data protection principles of lawfulness, purpose limitation, and data minimization.

3.2 User Consent and Rights

By using the Platform, you consent to:

  1. Collection and processing of personal data necessary for service delivery
  2. Verification of identity, employment history, and references (where applicable)
  3. Sharing of limited profile information with other Users for matching purposes

You retain rights to:

  1. Access, correct, or delete your personal data
  2. Withdraw consent (subject to service limitations)
  3. Lodge complaints with the Office of the Data Protection Commissioner (Kenya)

3.3 Sensitive Data

We do not intentionally collect special categories of personal data (e.g., health, biometrics, political opinions) unless strictly necessary and with explicit consent. House-helps may voluntarily share work-related certifications or training records.

3.4 Data Retention

Personal data is retained only as long as necessary for:

  1. Fulfilling contractual obligations
  2. Legal compliance (e.g., employment records)
  3. Legitimate business interests (e.g., fraud prevention)

3.5 Data Use Authorization

You explicitly authorize Helper Advisor to use, host, store, and display your data within the website (www.helperadvisor.com) to the extent necessary to match Househelps with Families/Employers and Agencies.

Upon account deletion, data is anonymized or securely erased per legal requirements.

4.Prohibited Activities and Cyber Security Safeguards

To protect the Platform, its Users, and its infrastructure, you strictly agree not to:

4.1 Malicious or Unauthorized Access

  1. Attempt to hack, penetrate, or disrupt the Platform's servers, networks, or security systems
  2. Use automated scripts, bots, scrapers, or crawlers to extract data without prior written consent
  3. Exploit vulnerabilities or conduct penetration testing without authorization

4.2 Fraud and Misrepresentation

  1. Create fake profiles, submit false reviews, or impersonate another person/entity
  2. Post fraudulent job listings or solicit payments outside the Platform
  3. Engage in identity theft or use stolen credentials

4.3 Harmful Content and Conduct

  1. Upload malware, viruses, ransomware, or any code designed to damage systems
  2. Distribute spam, phishing links, or social engineering content
  3. Harass, threaten, or discriminate against other Users

4.4 Intellectual Property Violations

  1. Copy, reproduce, or redistribute Platform content, design, or code without permission
  2. Reverse-engineer, decompile, or attempt to derive source code from the Platform

4.5 Legal Compliance

You agree to comply with the Computer Misuse and Cybercrimes Act (2018) and all applicable local and international cyber laws. Violations will be reported to law enforcement.

5.User-Generated Content and Moderation

5.1 Ownership and License

You retain ownership of content you post (profiles, reviews, messages). By posting, you grant us a non-exclusive, royalty-free, worldwide license to host, display, and distribute such content solely to operate and improve the Platform.

5.2 Content Standards

All content must be:

  1. Truthful, accurate, and non-defamatory
  2. Relevant to domestic employment services
  3. Respectful of others' privacy and dignity

5.3 Moderation Rights

We reserve the right to:

  1. Review, filter, or remove any content that violates these Terms
  2. Suspend or terminate accounts engaged in abusive behavior
  3. Use automated tools and human moderation to detect policy violations
  4. We are not obligated to pre-screen content but act promptly upon reports of abuse

6.Limitation of Liability and Disclaimers

6.1 "As Is" Service

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or uninterrupted security.

6.2 Neutral Technology Intermediary Status

  1. Role of the Platform: You acknowledge and agree that Helper Advisor is a neutral technology platform designed solely to facilitate the discovery of domestic services and employment opportunities. We provide the infrastructure for Users to connect; we are not a party to any agreement, contract, or employment relationship formed between Users.
  2. No Employment Relationship: Nothing in these Terms or your use of the Platform shall be construed as creating a partnership, joint venture, agency, or employer-employee relationship between Helper Advisor and any User. Helper Advisor does not employ House-helps, nor do we act as a representative for Families/Employers.
  3. Independent Responsibility: Users are solely responsible for negotiating the terms of any employment, performing their own due diligence (including background and health checks), and ensuring compliance with the Employment Act (Cap 226) and the Labour Institutions Act of Kenya.
  4. Statutory Obligations: Users are exclusively responsible for all statutory deductions and filings, including but not limited to PAYE, NSSF, NHIF, and the Affordable Housing Levy, as may be required under Kenyan Law. Helper Advisor assumes no liability for a User's failure to comply with these legal obligations.

6.3 Cap on Liability

To the maximum extent permitted by Kenyan law, our total liability for any claim arising from these Terms or your use of the Platform shall not exceed KSHs 10,000 or the amount you paid to use the Platform in the preceding 6 months, whichever is lower.

6.4 Indemnification

You agree to indemnify and hold harmless Helper Advisor, its affiliates, and agents from any claims, damages, or expenses (including legal fees) arising from:

  1. Your breach of these Terms
  2. Your misuse of the Platform
  3. Your violation of any third-party rights or applicable laws

7.Intellectual Property Rights

All Platform content, including software, design, logos, and trademarks, is owned by Helper Advisor and protected under Kenyan and international intellectual property laws. Unauthorized use is strictly prohibited.

8.Account Termination

We may suspend or terminate your account immediately, without notice, if you breach these Terms, including if you:

  1. Engage in fraudulent, illegal, or harmful activities
  2. Fail to respond to verification requests

Upon termination, your right to use the Platform ceases immediately. Provisions regarding liability, indemnification, and governing law shall survive termination.

9.Dispute Resolution and Governing Law

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.

9.2 Informal Resolution

We encourage Users to resolve disputes amicably through direct communication or Platform-supported mediation.

9.3 Formal Proceedings

Any unresolved disputes shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya, unless mandatory consumer protection laws provide otherwise.

10.Amendments and Notifications

We may update these Terms periodically. Material changes will be communicated via:

  • In-Platform notifications
  • Updated "Last Updated" date at the top of this document

Continued use after changes constitutes acceptance.

11.Additional Protections for Platform Integrity

11.1 Security Measures

We implement industry-standard technical and organizational measures to protect against unauthorized access, including:

  1. Encryption of sensitive data in transit and at rest
  2. Regular security audits and vulnerability assessments
  3. Multi-factor authentication options
  4. Rate limiting and intrusion detection systems

However, no system is 100% secure. You acknowledge that you use the Platform at your own risk.

11.2 Third-Party Services

The Platform may integrate third-party tools (e.g., payment processors, cloud hosting). Their privacy practices are governed by their own policies. We are not responsible for their actions but strive to partner with reputable providers.

11.3 Automated Decision-Making

We may use algorithms to match Users or flag suspicious activity. You have the right to request human review of significant automated decisions affecting your account.

12.Data Protection Compliance & Breach Notification

  • Compliance Commitment: Helper Advisor operates in strict accordance with the Data Protection Act (2019). We have initiated the mandatory registration process with the Office of the Data Protection Commissioner (ODPC) in Kenya and adhere to the data protection principles outlined in the Act.
  • Breach Notification: In the event of a suspected personal data breach, we will notify the ODPC within 72 hours and inform affected Users as soon as reasonably practicable, as required under Section 43 of the Data Protection Act (2019).

13.Payments and Financial Transactions

  • Third-Party Processor: Helper Advisor uses Paystack as a third-party payment gateway. By making payments on the Platform, you agree to be bound by Paystack's Terms of Service and Privacy Policy.
  • No Storage of Sensitive Financial Data: Helper Advisor does not store your full credit card numbers or bank account authentication details on our servers. All such data is handled directly by Paystack.
  • Transaction Liability:We are not liable for payment failures, double charges, or unauthorized transactions occurring on Paystack's infrastructure. Any payment-related disputes must be directed to Paystack in the first instance.

14.Statutory Cybercrime Disclosure

In compliance with the Computer Misuse and Cybercrimes Act (2018), any User found engaging in "unauthorized interference," "unauthorized interception," or "cyber-harassment" will have their data preserved and handed over to the National Kenya Computer Incident Response Team Coordination Centre (KE-CIRT/CC) or relevant law enforcement.
