How Helper Advisor ("we," "us," or "our") collects, processes, and protects your personal data — in compliance with the Kenya Data Protection Act, 2019 (DPA) and the Computer Misuse and Cybercrimes Act, 2018 (CMCA).

1.Introduction

Helper Advisor ("we," "us," or "our") operates the platform located at www.helperadvisor.com. This Privacy Policy explains how we collect, process, and protect your personal data in compliance with the Kenya Data Protection Act, 2019 (DPA) and the Computer Misuse and Cybercrimes Act, 2018 (CMCA).

By registering an account, accessing, or using the website, you explicitly allow and authorize Helper Advisor to use your personal data within the website. This authorization allows us to display limited profile elements to facilitate legitimate matching and connection services between Househelps, Families/Employers, and Agencies. You acknowledge that without this authorization, the platform cannot function effectively to provide you with connection services.

3.Data We Collect

To deliver our services, we collect and process the following categories of data:

  • Identity Data: Full name, National ID/Passport number (for background verification), and gender.
  • Contact Data: Phone number, email address, and approximate physical or geographical location.
  • Professional Data (Househelps): Employment history, specialized skills, language competencies, certifications, and references.
  • Financial Data: Payment and transaction confirmations from our integrated third-party gateway, Paystack. We do not store full card numbers or security codes.
  • Technical Data: IP addresses, login data, browser types, and system logs captured for security auditing under the CMCA (2018).
  • Verification Data: Results of any voluntary background checks or vetting processes.

4.Purposes of Processing and Data Use

We use the data you allow us to collect for the following operational purposes:

  • Displaying relevant worker skills, experience, and approximate locations to searching Employers.
  • Displaying active job listings from Employers to searching Househelps or Agencies.
  • Verifying identities and background references to preserve the safety and integrity of the platform community.
  • Processing secure payments via Paystack.

5.Data Security & Cybercrime Preventions

In strict compliance with the Computer Misuse and Cybercrimes Act (2018), we implement enterprise-grade protection mechanisms:

  • Encryption: All data in transit and at rest is secured using industry-standard SSL/TLS and AES-256 protocols.
  • Access Control: Access to sensitive identification documents is strictly firewalled and limited to authorized vetting staff.
  • Zero-Tolerance Policy: Any attempt at unauthorized access, system scraping, data interception, or introducing malware will result in immediate account termination and legal escalation to the National KE-CIRT/CC.

6.Data Protection Status & Breach Notification

  • Helper Advisor has initiated its registration process with the Office of the Data Protection Commissioner (ODPC) in Kenya as a Data Controller and Data Processor.
  • In the event of a verified data breach, we will report the incident to the ODPC within 72 hours and alert impacted users as soon as practically viable, matching our duties under Section 43 of the DPA.

7.Data Sharing Limitations

  • Platform Visibility: Your data is only visible to other registered, authenticated users of the website for matching purposes.
  • Third Parties: We do not trade, sell, or rent your personal data. Data is only shared with specialized infrastructure partners (e.g., Paystack, cloud hosts) operating under strict data protection agreements.
  • Legal Disclosures: We will only surrender data to state authorities if compelled by a legitimate, valid Kenyan court order or warrant.

8.Your Data Subject Rights

Under the DPA (2019), you retain control over your data and possess the right to:

  • Access: Review the personal information we hold about you.
  • Rectify: Request immediate modification of outdated or inaccurate information.
  • Erasure: Request the complete deletion of your profile and historical records.
  • Withdraw Consent: Revoke your authorization for data processing, which will result in the closure of your platform account.

9.Retention Periods

We store your personal data for the lifespan of your active platform membership. Following account closure, minimal identity and financial history logs are archived for seven (7) years to ensure compliance with Kenyan statutory tax obligations and limitation of actions laws.
